The Lagos State High Court in Ikeja has declared that the initial impeachment of Mudashiru Obasa as Lagos Assembly Speaker is illegal and unconstitutional.

During a sitting at the court on Wednesday, Justice Yetunde Pinheiro nullified the House’s proceedings and resolutions of January that led to Obasa’s ouster.

Obasa was impeached by 36 lawmakers at the state parliamentary House. He thereafter filed a suit against the legislators through his lawyer, Afolabi Fashanu, citing his outster from his Speaker’s position as unlawful and acted on without due course and convened without his authority or a formal delegation of power in violation of the House’s procedures.

The suit was based on nine grounds, referencing relevant provisions of the 1999 Constitution (as amended) and the Standing Orders of the Lagos State House of Assembly.
