Afolabi Kazeem Michael, popularly known as KC Luxury, has sought a judge’s recusal concerning his trial in the Federal High Court in Lagos. Through his lawyer, KC Luxury filed a recusal application amid a 22-count charge alleging conspiracy to export 184.5kg of cocaine to the United Kingdom and money laundering.

In a formal application filed before the court, counsel for the defendant argued that the trial judge’s earlier comments and handling of preliminary matters had created a reasonable apprehension of bias. The defence team maintained that continuing under the same judge would compromise the integrity of the trial and the defendant’s right to a fair hearing.

The case, which has drawn significant public attention, involves allegations of large-scale cocaine trafficking linked to operations that allegedly passed through Lagos. KC Luxury has pleaded not guilty to the charges. Proceedings have been marked by repeated legal skirmishes, including disputes over bail, the admissibility of evidence and the pace of the trial.

At today’s sitting, the defence counsel told the court that their client had lost confidence in the judge’s ability to approach the matter with the required neutrality. They pointed to specific rulings and courtroom exchanges which, in their view, suggested a predisposition against the defendant. The lawyers insisted the application was not an attack on the judiciary but a necessary step to protect the integrity of the process.

Prosecutors opposed the move, describing it as a delaying tactic designed to frustrate the trial. They argued that the defence had failed to provide concrete evidence of bias and that routine judicial comments or adverse rulings did not automatically justify recusal. The prosecution urged the court to dismiss the application and allow the substantive trial to proceed without further interruption.

The judge reserved ruling on the application and directed both sides to file additional written arguments. A date was fixed for the decision. Until then, further hearing on the main charges remains suspended.

Legal observers note that applications for recusal are not uncommon in high-stakes criminal trials in Nigeria, particularly those involving narcotics and prominent defendants. Courts generally apply a careful test: whether a fair-minded and informed observer would conclude there is a real possibility of bias. Success rates vary, and judges often emphasise the need to balance a defendant’s rights with the public interest in the efficient administration of justice.

The development adds another layer of complexity to a case already closely watched by anti-narcotics agencies, the business community and the wider public. Whatever the outcome of the recusal request, it is expected to influence both the timeline and the atmosphere of the trial in the weeks ahead.
